These Terms & Conditions apply to purchases made through The Curated's European online store.

In these Terms, “The Curated”, “we”, “us” and “our” refer to The Curated AS.

These Terms apply to consumers purchasing products for personal use.

Nothing in these Terms excludes or restricts rights granted to consumers under mandatory applicable law.

If you are a consumer habitually resident in another EEA country, you retain mandatory consumer protections applicable to you under the law of your country of habitual residence.

2. PRODUCTS & AVAILABILITY

All products are subject to availability.

Adding a product to your shopping bag does not reserve it.

Subject to applicable law, we reserve the right to:

  • discontinue or withdraw products;
  • limit quantities available for purchase;
  • correct product information;
  • refuse orders reasonably suspected of fraud or abuse;
  • refuse orders reasonably suspected of being intended for unauthorised resale or commercial distribution; and
  • correct obvious errors.

If a product becomes unavailable after you order it, we will inform you and refund any amount paid for the unavailable product.

3. PRODUCT INFORMATION

We take reasonable care to ensure that descriptions, photographs, composition information and measurements are accurate.

However, colours may vary depending on your screen, device settings, lighting and photography.

Natural materials including wool, cashmere, silk and leather may display reasonable variations in colour, texture, grain and finish.

Measurements are approximate and reasonable manufacturing tolerances may occur.

Such reasonable variations do not constitute defects where the product otherwise corresponds to its description and the quality a consumer may reasonably expect.

Nothing in this section affects statutory rights relating to defective or non-conforming goods.

4. ORDERS

Before submitting an order, you will have an opportunity to review your selected products, delivery information and total price.

After an order is submitted, an order confirmation will normally be sent electronically to the email address provided at checkout.

Failure to receive an order confirmation does not by itself mean that an order was not received or concluded. If you do not receive an order confirmation, please contact Client Services.

You are responsible for ensuring that the email address and other contact information provided with your order are complete and accurate. Please check your spam or junk folder if you do not receive an expected communication from us.

Subject to applicable law, we reserve the right to cancel or reject an order where reasonably necessary because of:

  • product unavailability;
  • inability to authorise or verify payment;
  • suspected fraud;
  • misuse of promotional codes, credits or benefits;
  • an obvious pricing or technical error;
  • unusual or abusive ordering activity;
  • suspected unauthorised resale or commercial purchasing; or
  • restrictions preventing delivery.

Where an order is cancelled and payment has already been collected, the relevant amount will be refunded.

5. ELECTRONIC COMMUNICATIONS

Order confirmations, shipping confirmations, invoices, delivery updates, pre-order updates and other communications relating to your purchase may be provided electronically using the contact information supplied with your order.

The Curated is not responsible for a customer's failure to receive or review a communication where it was sent to the contact information provided by the customer, to the extent permitted by applicable law.

This does not affect mandatory consumer rights or any obligation of The Curated to provide information required by law.

6. PRICES, VAT & DUTIES

Prices are displayed in the currency applicable to your selected market.

For deliveries within the European Union and Norway, displayed consumer prices include applicable VAT.

Duties and applicable import charges are included or prepaid for deliveries within the European Union and Norway. No additional import duties should therefore be due upon delivery.

Shipping charges, where applicable, will be displayed before checkout is completed.

Prices may change from time to time. Changes will not affect purchases already concluded.

Despite our reasonable efforts, pricing errors may occur.

Where a price is obviously incorrect, we reserve the right, to the extent permitted by applicable law, to correct the error or cancel the affected order. Any amount already paid for a cancelled product will be refunded.

7. SALES, PROMOTIONS & DISCOUNT CODES

Price reductions and promotional offers are subject to applicable consumer and pricing laws.

Promotional codes and other benefits may be subject to specific conditions communicated with the offer.

Unless otherwise stated:

  • promotional codes cannot be combined;
  • promotional benefits have no cash value;
  • promotional codes may not be sold or reproduced for commercial purposes; and
  • only one promotional code may be used per order.

We may refuse or adjust a promotional benefit where we reasonably believe it has been obtained or used fraudulently, unlawfully, contrary to its stated conditions or as a result of a technical error.

Nothing in this section affects mandatory consumer rights.

8. PAYMENT

Available payment methods are displayed at checkout.

Payments may be processed by third-party payment providers.

By providing payment information, you confirm that you are authorised to use the selected payment method.

Transactions may be subject to payment authorisation, identity verification, fraud-prevention and security checks.

9. PRE-ORDERS

Certain pieces may be offered for pre-order before they are available for immediate dispatch.

Pre-order products will be clearly identified on the relevant product page.

The expected dispatch or delivery period shown for a pre-order is an estimate unless expressly identified as a guaranteed delivery date.

By purchasing a pre-order product, you acknowledge that it is not available for immediate dispatch and agree to the estimated delivery period communicated at the time of purchase.

Production, freight, customs clearance and other circumstances may occasionally affect expected availability.

If the estimated timing changes materially, we will provide updated information where reasonably practicable.

Nothing in this section limits rights you may have under mandatory consumer law in relation to delayed delivery.

Unless otherwise stated, payment for a pre-order may be collected when the order is placed.

Your statutory withdrawal period generally begins when you receive the product.

If an order contains both available and pre-order products, they may be dispatched separately.

10. DELIVERY

Available delivery methods, charges and estimated delivery periods are displayed at checkout.

Delivery times are estimates unless we expressly agree to a guaranteed delivery date.

Circumstances outside our reasonable control may occasionally affect delivery. Mandatory rights relating to delayed delivery remain unaffected.

You are responsible for providing complete and accurate delivery information.

Where a parcel cannot be delivered because materially incorrect or incomplete information was supplied, or because delivery or collection is repeatedly refused or missed, we may charge reasonable additional costs actually incurred in returning or reshipping the parcel where permitted by applicable law.

Risk of loss or damage generally passes to you when you, or a third party nominated by you other than the carrier, takes physical possession of the goods.

11. CHANGING OR CANCELLING AN ORDER

If you wish to change or cancel an order before dispatch, please contact Client Services as soon as possible.

We process orders quickly and cannot guarantee that an order can be changed or intercepted once processing has begun.

Once dispatched, an order cannot normally be cancelled operationally.

This does not affect your statutory right of withdrawal.

12. STATUTORY RIGHT OF WITHDRAWAL

If you are a consumer purchasing online within the European Economic Area, you generally have the right to withdraw from your purchase without giving a reason within 14 days after receiving the goods.

You may exercise this right through our Withdraw from Your Order function, our returns process, or by sending us another clear statement communicating your decision to withdraw.

After notifying us of your withdrawal, you must return the products without undue delay and no later than 14 days after communicating your withdrawal.

13. CONDITION OF RETURNED PRODUCTS

You may inspect and try on a product to the extent reasonably necessary to establish its nature, characteristics and fit, in the same way you reasonably would in a physical store.

You are responsible for any reduction in value resulting from handling beyond what is reasonably necessary for that purpose.

Where permitted by applicable law, we may make an appropriate deduction from your refund reflecting that diminished value.

To avoid a deduction, returned products should be:

  • unworn other than for reasonable fitting;
  • unwashed;
  • unaltered;
  • undamaged;
  • free from stains, make-up, deodorant, fragrance, odours, pet hair or other contamination;
  • returned with original tags and security tags attached where supplied; and
  • returned with accessories and components supplied with the product.

The Curated may reasonably document the condition of returned products for quality control, fraud prevention and assessment of diminished value.

Where reasonably possible, products should be returned in their original packaging, including any garment bags, protective packaging, boxes or other packaging supplied with the product.

If the original shipping box is no longer suitable, the product must be securely packaged in appropriate protective packaging to prevent damage during return transit.

Customers are responsible for taking reasonable care when packaging returned products. Where inadequate packaging causes damage to or diminishes the value of a product, The Curated may make an appropriate deduction from the refund to the extent permitted by applicable law.

Failure to use the original shipping box alone will not affect your statutory right of withdrawal.

14. RETURN COSTS

For ordinary change-of-mind returns and statutory withdrawals, you are responsible for the direct cost of returning the products, except where applicable law requires otherwise.

For EU orders, The Curated offers a prepaid return label for €25 per return.

If you use our prepaid return service, the €25 charge will be deducted from your refund.

Different conditions apply where a product is defective or non-conforming.

15. REFUNDS

Where you exercise your statutory right of withdrawal, reimbursement will be made without undue delay and within the timeframe required by applicable law.

We may withhold reimbursement until we have received the returned products or you provide evidence that they have been sent back, whichever occurs first, where permitted by applicable law.

Refunds will ordinarily be issued to the original payment method.

Where required by applicable law, if you withdraw from the entire order, we will also reimburse the cost of our least expensive standard outbound delivery option.

If you selected a more expensive delivery service, such as express or premium shipping, the additional amount above our standard delivery cost will not be reimbursed.

Where applicable and legally permitted, we may deduct:

  • the €25 prepaid return charge where our return label is used; and
  • an appropriate amount reflecting diminished value resulting from handling beyond what was reasonably necessary to inspect the product.

Your bank, card issuer or payment provider may require additional time for a processed refund to appear in your account.

16. DEFECTIVE OR NON-CONFORMING PRODUCTS

If a product is defective, damaged or does not conform to the sales contract, please contact Client Services.

Rights relating to defective or non-conforming products are governed by applicable mandatory consumer law and are separate from the 14-day right of withdrawal.

Depending on the circumstances and applicable law, available remedies may include repair, replacement, price reduction or refund.

Where The Curated is legally responsible for a defective or non-conforming product, we will bear reasonable return costs as required by applicable law.

Nothing in these Terms restricts statutory conformity or guarantee rights.

17. FAIR USE, FRAUD & ABUSE

Subject to applicable law, The Curated reserves the right to refuse future transactions, restrict services, require additional verification, or suspend or close accounts where we reasonably identify:

  • fraudulent activity;
  • abuse of return or refund processes;
  • wardrobing or repeated use and return of products;
  • excessive or abnormal return activity;
  • payment fraud or chargeback abuse;
  • misuse of promotional codes, store credit or customer benefits;
  • creation of multiple accounts to circumvent restrictions;
  • suspected unauthorised resale or commercial purchasing; or
  • other material misuse of our Website or services.

This does not remove statutory rights relating to purchases already made.

18. PRODUCTS PURCHASED ELSEWHERE

Returns and refunds through our Website are available only for products purchased directly from The Curated.

Products purchased from department stores, boutiques, marketplaces or other third-party retailers should normally be returned to the retailer from which they were purchased.

This does not affect rights you may have under mandatory applicable law.

19. INTELLECTUAL PROPERTY

The Curated name, trademarks, product designs, photographs, videos, graphics, artwork, copy, editorial material, Website design and other original content are owned by or licensed to The Curated and protected by applicable intellectual property laws.

Website content is provided for personal, non-commercial use.

Without our prior permission, you may not commercially reproduce, distribute, modify, republish, scrape, systematically extract or exploit Website content except where applicable law expressly permits such use.

20. WEBSITE USE

You must not misuse the Website, attempt unauthorised access, interfere with its operation, introduce malicious software or circumvent security measures.

We may restrict access where reasonably necessary to protect The Curated, our customers or our systems.

We cannot guarantee that the Website will always be available, uninterrupted or free from errors.

21. THIRD-PARTY SERVICES

Our Website may contain services, integrations or links provided by third parties, including payment and technology providers.

Where a third party provides services directly to you, its own terms and privacy practices may apply.

The Curated is not responsible for third-party services outside our reasonable control except where liability cannot lawfully be excluded.

22. LIABILITY

Nothing in these Terms excludes or limits liability or consumer rights that cannot legally be excluded or limited.

Subject to mandatory applicable law, The Curated is not responsible for losses that:

  • were not reasonably foreseeable;
  • result from your breach of these Terms;
  • arise from circumstances outside our reasonable control; or
  • constitute business or commercial losses arising from a consumer purchase.

Any limitation or exclusion contained in these Terms applies only to the maximum extent permitted by applicable law.

23. CIRCUMSTANCES OUTSIDE OUR CONTROL

The Curated will not be responsible for delay or failure to perform caused by circumstances outside our reasonable control.

These may include natural disasters, extreme weather, fire, flood, war, civil unrest, governmental measures, sanctions, strikes, transportation disruption, customs disruption, major interruptions to utilities or telecommunications, significant cyber incidents affecting third-party infrastructure, or material failures by logistics providers outside our reasonable control.

Mandatory consumer rights remain unaffected.

24. CHANGES TO THESE TERMS

We may update these Terms from time to time.

The Terms applicable to a purchase are the version in effect when the relevant order was placed.

Changes will not retrospectively alter the terms governing an existing purchase.

25. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.

26. GOVERNING LAW & DISPUTES

These Terms and contracts between you and The Curated are governed by Norwegian law.

If you are a consumer habitually resident in another EEA country, this choice of law does not deprive you of mandatory consumer protections applicable under the law of your country of habitual residence.

We encourage you to contact Client Services first if you have a complaint so that we can attempt to resolve it directly.

Disputes may be brought before the competent Norwegian courts, subject to mandatory rights you may have as a consumer to bring or defend proceedings in another jurisdiction.
